Description

In order to relieve traffic congestion in downtown LaGrange and relieve traffic along State Route 1 (also US 27), GDOT is planning to construct a new bypass from SR 1 to Youngs Mill Road, connecting to North Davis Road Bypass. The estimated two-mile stretch of road will consist of two 12-foot-wide travel lanes in either direction with a 24-foot raised median. Shoulders would be 10 feet wide, with 6.5 feet paved. The project will also convert a sharp 90-degree curve on US 27 into a three-way intersection for safety.

No pedestrian or bicycle facilities are included, though utilities and/or drainage will undoubtedly be addressed. Reduced conflict points compared to the current route should also enhance safety.

Business and Homeowner Concerns

Whenever a brand-new road is proposed, property owners should immediately be wary. There is no existing right-of-way, and while GDOT may try to avoid improvements, the lay of the land and natural obstacles are generally more costly to circumvent than a home or business.

Right-of-way takings, therefore, may take land along the border of a parcel or cut it in half. Whether it is a home, a farm, or a business, these types of takings can be particularly disruptive. More than 15 parcels will be affected.

The government can take your business or residential property for projects that serve the public good through eminent domain. Even if they do not take your land, they make take easements that permanently limit the way you’re allowed to use your property.

They can even take temporary construction easements that could last for years! However, the Constitution requires the government to offer you fair property compensation.

It’s vital to understand that GDOT, like most consumers, wishes to acquire the property it wants for the lowest price possible. This means the initial offer will likely be too low and won’t fully account for your property’s worth. We can help you see how they might not be considering certain things such as relocation expenses, and then fight for just compensation instead!

What to Do if Your Property Is Affected

GDOT has set aside an estimated nearly $4.5 million in right-of-way acquisition for this project. We encourage you to consult with an experienced eminent domain attorney before accepting an offer from GDOT for your land. We can examine the offer, and often discover a great deal more value in your property.

The initial offer is just the beginning of the conversation, but only if you don’t accept it. We can help you try to attain more. Call 1-888-391-1339 or contact us online for a complimentary case evaluation.

We only take a fee based on a percentage of what we’re able to help you receive beyond the government’s initial offer.2 That amount is completely yours and we never touch it.

We also front the costs of fighting your case, including hiring land appraisers, engineers, and other professionals who can help obtain a more accurate valuation for your land than what the government’s initial offer will likely reflect.

evaluation today.

There are only a handful of attorneys in GA who practice eminent domain exclusively. And even fewer with DOT experience. That’s why it’s always worth it to get a free case evaluation.

Here’s how it works:

1) Tell us about your situation.

2) We research your property as needed, using DOT maps, our own technology, and experience to see the exact effects.

3) We let you know what we think a fair offer would be. This evaluation is free, and there’s no
pressure or obligation to hire us after.

But please don’t wait to act. Waiting can hurt your case, and the cost is the same: free.
