Description

GDOT plans to add a single option express lane in both directions of travel to I-285 between I-20 and Henderson Road. The new 12-foot outside lanes would be separated from existing lanes via pavement striping and delineators. Access to the lanes would come from direct access ramps and, from the existing travel lanes, slip ramps.

Business and Homeowner Concerns

The ten-mile stretch of road will take necessary property from owners adjacent to the project. The east side express lanes are part of an initiative to add express lanes around most of I-285, and the government has taken significant property already.

In addition to the 12 additional feet needed for the new travel lane, expect GDOT to take a bit more as it may need to rework shoulders and other necessities. There may be drainage and utility easements taken, and “temporary” construction easements may last for many years on this project. Property owners should also be extremely vigilant for damage via inverse condemnation.

What to Do if Your Property Is Affected

GDOT can take your land, but not your rights. The government has set aside just $6 million for right-of-way acquisition for this project – and they will try to spend even less. Offers are coming to property owners in the path of the project, but if you accept that initial offer, you could be leaving significant money on the table.

You have the right to fair compensation. That initial offer from GDOT is just the beginning – as long as you do not accept it. Fight for more. Call 1-888-391-1339 or contact us as soon as possible for a complimentary case evaluation.

We do not take an attorney’s fee unless we increase the government’s offer, and our fee only comes from the increased amount – our no fee guarantee. The initial offer is entirely yours regardless of what you do next or what we may be able to obtain. Further, we front the costs of fighting your case and if we’re unable to increase the government’s offer to you, you don’t pay them. We do. That is how confident we are that we can assist you.

Affected Parcels

An estimated 16 parcels of property will be affected by the I-285 Eastside Express Lanes project in DeKalb County. The project’s budget for right or way takings is a scant $6 million, but that does not mean you cannot fight for maximum compensation. Whether your property is residential or commercial in nature, it is critical to understand that the government’s initial offer is just that – initial. We do not recommend you accept the initial offer.

evaluation today.

There are only a handful of attorneys in GA who practice eminent domain exclusively. And even fewer with DOT experience. That’s why it’s always worth it to get a free case evaluation.

Here’s how it works:

1) Tell us about your situation.

2) We research your property as needed, using DOT maps, our own technology, and experience to see the exact effects.

3) We let you know what we think a fair offer would be. This evaluation is free, and there’s no
pressure or obligation to hire us after.

But please don’t wait to act. Waiting can hurt your case, and the cost is the same: free.
